Environmental Regulation Update – 2013 Very Busy Year of Change!

The existing EU RoHS Directive (2002/95/EC) has been in place since July 1st 2006, but is due to be replaced by the new recast (2011/65/EU) version by 2nd January 2013 in all EU Member States. Whilst no new substances were added to the six types already restricted, some other very significant changes have occurred and electronics manufacturing companies should be preparing now, not least of which is the requirement as of January 2013 for “CE” marking and Declarations of Conformity as mandatory evidence of product RoHS compliance.
Meanwhile in the USA, the rules relating to supply chain traceability of certain key raw materials for electronics were finally published on 22nd August 2012. Reporting requirements for these rules also commence in January 2013, with companies needing to have systems in place to gather their first year of compliance data ready for submission by 31st May 2014.
Finally, companies need to consider preparation for the replacement of the existing EU WEEE Directive (2002/96/EC) with the recast version (2012/19/EU) agreed in 2012 and due to be implemented in Member States by 14th January 2014.
